“ADESA / Carvana – Transportation Delays and Arbitration Concern
We purchased a Jeep Gladiator through ADESA and had the vehicle transported through Carvana’s transportation network. Our experience has raised serious concerns about the current transportation and arbitration process.
At the time of purchase, we were unable to purchase PSI at checkout. We were not made aware before completing the purchase that PSI would not be available for this transaction. In our view, this lack of disclosure made it difficult to understand what protections would be available to us.
The vehicle was transported through the Carvana/ADESA transportation network, and by the time it was delivered, the applicable arbitration window had expired or was no longer available. When the vehicle arrived, we discovered a major transmission problem.
This creates what we believe is a significant problem for buyers purchasing vehicles from outside their local market. If transportation takes long enough for the arbitration period to expire before the buyer can inspect and operate the vehicle, the buyer may have no practical opportunity to identify and arbitrate a major mechanical issue.
We are particularly concerned about the current arbitration policy and the way the transportation timeline interacts with the arbitration window. We believe the process should provide buyers with a reasonable opportunity to inspect a vehicle after delivery, especially when transportation delays are outside the buyer’s control.
We have reached out to representatives within both Carvana and ADESA regarding this issue but have not received a satisfactory response.
We are requesting that the Jeep Gladiator be returned and the transaction reviewed, given that the vehicle arrived with a major transmission problem and we were unable to obtain a meaningful opportunity to inspect and arbitrate the issue within the applicable timeframe.
There is also a separate issue involving another Jeep purchased through ADESA. The keys were reportedly lost during the process, and we were not contacted regarding the issue. As a result, we incurred additional floorplan interest for several weeks. We have not received a credit or satisfactory response regarding those additional costs.
Our overall concern is that the current ADESA/Carvana transportation and arbitration process does not adequately protect buyers when transportation delays consume the available arbitration period.“
